中国劳动法学在近年虽有较快发展，但其理论指导和理论体系方面始终是薄弱环节，至今未形成较为完整的理论框架。本书借鉴市场经济国家劳动法制理论框架，结合中国的劳动关系和劳动法制的实际状况，以劳权理论为基本理论线索，以劳工保护为基本出发点，以劳资共同发展为目的，按照劳动法律体系的内容构成，以个别劳动法为基础，以集体劳动法为重点，“法理、法律、法治”相融合，提出了一个全新的劳动法学教科书的体系。

本书将我国劳动法律的介绍和解析作为基本内容，使读者既对中国的劳动法律有基本了解，也能对其要点有所把握。在介绍中国劳动法律的同时，本书结合国外劳工立法的状况予以比较和评析，以突出中国劳动法律在全球化背景下的共性和特性。
